Terms and Conditions

This site is owned and operated by Original Parts Clothing Limited, registered office address 71-75 Shelton Street, Covent Garden, London, United Kingdom, WC2H 9JQ, company registration number 15164910 (hereafter referred to as Original Parts/we/our/us/).

All rights in this website are owned by Original Parts. Any unauthorised use, copying or modification is prohibited.

Applicability of terms

These terms and conditions apply every time you access our website and/or order goods from our website and create a legally binding agreement between you and Original Parts. 

You should read these terms and conditions carefully before using this website/placing an order.  You may wish to print a copy for future reference.  

We reserve the right to change these terms and conditions and changes will take effect when posted on the website.  It is your responsibility to read the terms and conditions on each occasion you use this website.  Your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.

Please make sure that you have read and understood our Privacy Policy which explains how we safeguard any data which you provide to us in order for us to fulfil your online order.

Ordering Goods

You must be at least 18 years old to enter into an agreement and place an order with us.  You must be a consumer - not a reseller. 

All orders placed through our website will be subject to our acceptance of the order.

When you submit an order, we will send you an email acknowledging receipt of your order. 

Your order will be accepted by us (and a contract will then be formed between us) when we despatch the goods to you.  We will send you an email confirming that the products have been shipped.   

Fulfilment of all orders is subject to availability.  If we are unable to supply you with a product, we will inform you of this in writing and will not process the order.

We reserve the right not to accept your order for any reason. 

We also reserve the right to cancel an order/contract if:

  • The item ordered is not available/in stock
  • Your billing information is not correct or not verifiable 
  • Your order is flagged up by our security systems as an unusual order or an order susceptible to fraud
  • You are under 18
  • We could not deliver to the address provided by you

In these circumstances, you will receive a full refund of the amount paid. 

Goods will not be supplied for the purposes of re-sale and are only supplied for your own use as a consumer. We reserve the right to refuse orders including those we consider are for commercial or non-domestic purpose.

Overseas orders will not be accepted.

Pricing 

All prices shown on our website are inclusive of VAT at the applicable current rates. Delivery charges are clearly highlighted throughout the site.

Errors, inaccuracies and omissions

Whilst it is our intention to keep our website up to date and error free, occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, delivery times and availability.  If we discover such an error after you have submitted an order to us, we will contact you prior to accepting your order with the correct details. You may then either cancel your order or re-confirm it based on the correct information. If we are unable to contact you, we will treat your order as cancelled.

Payment

We accept payment by credit/debit card/Apple pay.  Your payment will be deducted as soon as the order is received.

Delivery

We aim to deliver all items which you have ordered in the same shipment.  Delivery charges and estimated delivery timescales are specified when you place an order and in the delivery section.  We cannot guarantee delivery on a particular day and do not accept liability for deliveries made outside this timescale. 

When we deliver your items to you, you may be asked to sign for the goods to acknowledge that you have received them or the delivery driver may take a photograph of the products at a distance with your door open, which may include images of you. 

Upon delivery, please inspect the packaging for damage. If it appears that the products are damaged, please do not accept the shipment.  

If after opening the packaging, there is an issue, please contact us at support@originalpartsclo.co.uk quoting your order reference number at the earliest opportunity. 

This website is only for delivery of products to customers in mainland UK, Northern Ireland and to the Scottish Islands, Isle of Scilly and Isle of Man.   

We may not be able to arrange delivery to some postal addresses in Northern Ireland, some offshore islands and some remote areas of Great Britain.  You will be notified of this as soon as possible and your order will be cancelled and any payment refunded.  

We cannot deliver to BFPO addresses or the Republic of Ireland. 

We reserve the right to stop a delivery at any time, including after despatch, if we suspect that the transaction might be fraudulent.

We cannot accept liability for out-of-pocket expenses or other costs incurred due to failed or delayed deliveries.

Cancellation

You have the legal right to cancel your order under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.  This cancellation right does not apply to personalised products. 

The cancellation period will expire 14 days after the goods are received by you or by a third party nominated by you to receive the goods. If your order is for multiple products for separate delivery, the cancellation period will end 14 days after receipt of the last item. 

You must clearly communicate to us your decision to cancel before the end of the cancellation period. You can do this by sending us an email to support@originalpartsclo.co.uk or completing and sending us the Model Cancellation Form found here 

If your order has not yet been processed, we will process the cancellation request and send you a confirmation. 

If cancellation is not possible because the goods have already been despatched from our warehouse, the product(s) will be delivered to you and may be returned. 

If you do cancel, we will reimburse you the cost of the cancelled goods by the original means of payment. 

Where the goods have not been delivered, the reimbursement will be made within 14 days of the cancellation. 

Where the goods have been delivered, the reimbursement will be made within 14 days of us receiving the goods back or us receiving evidence that you have returned the goods.  

Refunds will be issued based on the original form of payment.

You are responsible for returning the goods to us if you cancel and will be responsible for paying for the cost of the return.  We advise that you return the goods using a tracked service and keep your proof of return/tracking information in a safe place.   Email us at support@originalpartsclo.co.uk for details of the return address. 

All items are inspected on return.  If you do not comply with the foregoing and the value of the product diminishes as a consequence thereof, we can hold you liable for such diminished value.

All returned items should be sent back to us in their original condition together with the original packaging and all brand tags.  Please make sure that the products you return are complete and not used in any way other than what is reasonably necessary to decide if you want to keep the products (which means you are allowed to try the item on but you cannot wear or wash the item or remove the tags).  

When trying on clothing, please be careful to ensure that it is not marked by scents, deodorant/anti-perspirant or make-up

If an item is returned to us worn, used, damaged or in an unsaleable condition, or where the above instructions have not been followed, we won’t be able to give you a refund and we may have to send it back to you and ask you to cover the delivery costs.  Alternatively, we (at our sole discretion) may choose to reduce your refund to reflect any reduction in the value of an item.

Faulty Goods 

If you believe an item is faulty, please contact us by email at support@originalpartsclo.co.uk with details of your concerns.  In the event your claim is justified, we will arrange an appropriate remedy. 

Title/Ownership

Title to the goods passes to you on the date when the products are delivered to you or are left with a person or at a place nominated by you. 

Risk

Risk of loss or damage of products passes to you on the date when the products are delivered to you or are left with a person or at a place nominated by you.

Conditions Applicable To Pre-Ordered Products

Pre-order is the process by which you are able to order a product in advance of the scheduled retail launch.  Concrete delivery times depend on the moment the product is available in our warehouse. Standard delivery timelines will apply from the moment the pre-ordered product is available in our warehouse. This information is best estimates only, timelines are not binding. 

Your payment will be deducted as soon as the order is received.

Promotional codes

Promotional codes are codes that enable customers to obtain benefits such as discounts, free delivery and free gifts. 

These codes are non-transferable so may only be used by the person to whom they are issued and must only be used in accordance with their terms and conditions of use. 

If you use a promotional code to claim a promotional benefit, you must first check that it was issued to you and that you are eligible to use it. By using it to claim a promotional benefit you will be confirming that you are entitled to use the code; you meet all the conditions that apply to it’s use and you agree to the terms and conditions of use.  

If, before accepting your order, we find that you are not entitled to use the code or do not meet all the terms and conditions of its use, we may reject your order or alternatively process it without the promotional benefit being applied. 

If, after accepting your order, we find that you were not entitled to use the code or did not meet all the terms and conditions of its use, we may reverse the benefit that you obtained.

If you transacted on a cash basis e.g. by debit or credit card, we may take a further payment, equivalent to the value of the benefit obtained, from the card used. 

Governing Law

The use of our site and any contracts formed are governed by English law.

The contract between us shall be governed by the laws of England and any dispute between us will be resolved in the courts of England. 

English is the only language offered for the conclusion of the contract.

If any provision of these terms and conditions is found to be invalid or unenforceable by a court, the remaining terms will remain in full force and effect.

Entire Agreement

These terms and conditions govern the entire trading relationship between you and us and will remain in force for the duration of our trading relationship.

Liability and Indemnity

Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability which may not otherwise be limited or excluded under applicable law.

We shall not be responsible to you whether in contract, tort (including negligence) or otherwise for incidental, special, indirect or consequential loss or damage, any loss of profit (direct or indirect), loss of sales, loss of goodwill or reputation, loss of business, third party claims, pure economic loss arising out of or in connection of the performance or non-performance of our obligations under these terms and conditions including such damage as may be reasonably foreseeable at the date you order the goods.

Our liability for any claim for loss or damage shall be limited to the sum paid by you for the goods.

We cannot accept liability for out-of-pocket expenses or other costs incurred due to failed or delayed deliveries.

This clause does not affect your statutory rights as a consumer, nor does it affect your contract cancellation rights.

Third Parties

These terms and conditions do not create or confer any rights or benefits enforceable by any person that is not a party (within the meaning of the U.K. Contracts (Rights of Third Parties) Act 1999).

Intellectual Property

All intellectual property rights are solely owned by us.  Any unauthorised use, copying or modification of our logos, graphics, content and material is strictly prohibited.

You are permitted to link to our homepage, provided that the link is not misleading, false, derogatory, or otherwise prejudicial to our interests, but you are expressly not permitted to use any of our logos or graphics either as or in connection with such a link.

You are expressly not permitted to download any part of our site (other than by reason of automatic page caching), to amend or modify it or any part of it, to reproduce or copy, sell (including any re-sale), or otherwise exploit our website (or any part of it) for any purpose other than as set out above.  

No Waiver

If we fail to insist that you perform any of your obligations under these terms and conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. 

If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

Events Outside Our Control

An ‘Event Outside Our Control’ means any act or event beyond our reasonable control, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks. 

If an Event Outside Our Control takes place that affects the performance of our obligations under these terms and conditions:

we will contact you as soon as reasonably possible to notify you; and

our obligations under these terms and conditions will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control.

Where the Event Outside Our Control affects our delivery of a product to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.

You may cancel the contract if an Event Outside Our Control takes place and you no longer wish us to provide the products.  Please see your cancellation rights under Cancellation above. 

Assignment

We may assign or transfer any of our rights or sub-contract any of our obligations under these terms and conditions to any third party.

You may not assign or transfer any of your rights or sub-contract any of your obligations under these terms and conditions except with our specific permission in writing.

Entire Agreement

This Agreement constitutes the entire agreement between us and you and supersedes all prior agreements, understandings, negotiations and discussions, whether oral or written.

There are no warranties, covenants, conditions or other agreements, express or implied, collateral, statutory or otherwise, between the parties in connection with the subject matter of this agreement except as specifically set out herein.

Complaints 

In the unlikely event that you have a complaint or are not satisfied with any aspect of this agreement, please contact us by email at support@originalpartsclo.co.uk and we will endeavour to resolve the matter.
